What if I have filed bankruptcy before? Can I file again?
How often are you entitled to bankruptcy relief? Filed bankruptcy before and wondering whether it is possible to file again? There are basic rules that apply to repeat bankruptcy filers. You can file bankruptcy again within certain limitations. If you have filed a chapter 7, there is a waiting period from the first date of filing to the second date of filing of eight years. If you have filed a chapter 7, you have to wait four years from the first date until you can file a chapter 13 again. There are some exceptions to these general rules of thumb and you should consult an experienced bankruptcy attorney to see if they apply to you.
